1. Who this covers

This Participant Agreement, Release of Liability, Assumption of Risk and Indemnity Agreement (the "Agreement") is between the participant named below ("I", "me") and Montana Precision Archery Co., its owners, members, employees, volunteers, agents, landlords and sponsors (together "MPA"). It applies every time I enter MPA's premises at 1113 Custer Ave Unit B, Kalispell, Montana, or take part in any MPA activity, including range use, lessons, leagues, events, bow tuning and equipment fitting, whether as a member, a guest or a spectator.

2. The risks

Archery is an inherently dangerous activity. I understand that the risks include, but are not limited to: injury from arrows, broadheads, bows, strings, cables, releases and other equipment; equipment failure, including dry-fires, derailments and broken arrows; the actions or inaction of other participants, spectators and staff; slips, trips and falls; the condition of the facility and targets; and the risk of serious bodily injury, permanent disability, paralysis or death. I understand that these risks cannot be eliminated regardless of the care taken to avoid injuries.

3. Assumption of risk

I knowingly and voluntarily assume all risks of participating, both known and unknown, even if arising from the negligence of MPA or others, and I accept full responsibility for my participation.

4. Release and waiver

To the fullest extent permitted by Montana law, I release, waive, discharge and agree not to sue MPA from and for any and all claims, demands, losses, damages and liability arising from my presence at MPA or participation in MPA activities, including claims arising from the ordinary negligence of MPA, but not claims arising from gross negligence or willful misconduct.

5. Indemnity

I agree to indemnify, defend and hold harmless MPA from any claim, loss or expense, including reasonable attorney fees, brought by me, my family, my guests or any third party that arises from my participation or from my violation of this Agreement or MPA's rules.

6. Rules and equipment

I will follow every posted range rule and every instruction given by MPA staff. I will not shoot until the line is clear and the command is given, I will not cross the line while anyone is shooting, and I will not use damaged equipment. I understand that MPA may remove me from the range at any time for unsafe conduct without refund. Equipment I bring is my responsibility; MPA may inspect it and may refuse to allow it on the range.

7. Medical

I confirm that I have no medical condition that makes participation unsafe. If I am injured and cannot speak for myself, I authorize MPA to obtain emergency medical treatment on my behalf, and I agree that I am responsible for the cost of that treatment.

8. Minors

If I am signing for a participant under 18, I confirm that I am the parent or legal guardian, that I have full authority to sign on the minor's behalf, that I have explained these risks to the minor, and that I agree to all terms of this Agreement for myself and the minor. I will supervise the minor at all times while on the premises unless the minor is enrolled in a supervised MPA program.

9. Photo and video

Only if I check the optional box below: I grant MPA permission to use photographs and video of me (or the minor) taken on the premises or at MPA events for its website, social media and marketing, without compensation.

10. Term, governing law and severability

This Agreement is effective on the date signed and remains in force for every visit until I revoke it in writing, and revocation is not retroactive. It is governed by the laws of the State of Montana. Venue for any dispute lies in Flathead County, Montana. If any part of this Agreement is held unenforceable, the rest remains in full force.

11. Electronic signature

I agree that signing this Agreement electronically, by typing my name and drawing my signature, has the same legal effect as a handwritten signature, and that MPA may store it electronically.

I HAVE READ THIS AGREEMENT, I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I SIGN IT VOLUNTARILY.
